how do you not favor the students who pay better attention throurh out the school year.

First try to find out where they are in the class.
Are they confused and are afraid to ask questions because they feel the other students will look down on them. If that is the situation, then work with that student on the side from time to time to make them feel better about being in the class, and show them that they do know the answers and to be proud and speak up.

Those students are already on the correct path. Pushing the ones that don't with questioning is an excellent way to try to put them back onto a similar playing field with those who are paying attention/interested. The students who don't pay as much attention typically are more difficult to work with but positive reinforcement and questioning can go a long way in gaining their interest.
