During the Admission process can you legally give an test to all to see where they are in their English comprehension?

I as an admission associate do not administer any assessments. We have a person who is not in admissions set themup on the assessment.
In general it is my understanding that a third party will administer this entrance exams. Can the exams b given to explore remedial courses, and can they be taken more than once? Is this basically left up to the Institution?

Any tests given must be fully described in the catalog and the determine criteria for admissions.
