Prequalifying a student without knowledge of disability

If a student applies for a program and there disability will not allow them to complete the course, is that student entitled to a full or partial refund even the the law prevents the institution to ask about a disability during enrollment?

If a student without a disability applies for a program and they fail the program because they don't have the skills necessary to make it through, are they entitled to a full or partial refund? The only reason a student with a disability would be entitled to refund is if the institution failed or refused to provide appropriate accommodations for the student.
