I may have over-looked this information but if keeping track of attendance is not required, how do you determine a students last date of attendance in regards to a refund?

I didn't know that schools weren't required to taked attendance. Its good that they have to develope other strategies.
There has to be a way they check attendance. I remember the instructor taking random roll calls in an effort to address attendance.

The school's attendance policy must be listed in the school catalog. Individual classes may have additional attendance policies that should be listed on the class syllabus.

You are not required to discuss every school policy listed in the catalog but if a student has questions about attendance you should refer the to the school policy. In addition to the general school attendance policy, some schools permit instructors to have additional requirements that would be listed in the course syllabus.

Is this something that we should discuss with a student when we are interviewing or going through the enrollment agreement? Or is that the responsibility of the instuructor to inform the student on how they keep track of attendance?

Schools are required to develop their own attendance policies and the attendance policy needs to be listed in the school catalog.

Is there a minimum number of days and/or hours a student is required to attend to complete the course? For example, the student is very smart and feels they can pass all the exams by only attending 1/2 of all the classes or 2 days a week.

According to Ohio Administrative Code 3332-1-10(F)(4), schools are not required to take daily attendance. However, if a school does not take daily attendance it must develop an alternative method to accurately determine a student's last date of attendace for refund purposes and this alternative method must be approved by the Board in writing.
